1. Acceptance of Terms

By accessing or using Listing Buddy ("the Service"), operated by Fennec Forge LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Listing Buddy is an AI-powered tool that helps online resellers create optimized marketplace listings. The Service generates titles, descriptions, pricing suggestions, and market intelligence for platforms including eBay, Poshmark, Mercari, and Facebook Marketplace.

3. Accounts

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account.
  • You must be at least 13 years of age to use the Service.
  • One person or entity may not maintain more than one account.

4. Free and Pro Plans

  • The Free plan includes up to 5 listing generations per calendar month.
  • The Pro plan provides unlimited listing generations for a monthly or annual subscription fee.
  • Subscription fees are billed in advance on a monthly or annual basis through Stripe.
  • You may cancel your Pro subscription at any time through the Account page or Stripe's customer portal. Access continues until the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact us for refund requests.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or to violate any laws
  • Upload images that you do not have the right to use
  • Attempt to circumvent usage limits or access controls
  • Use automated tools to access the Service in an abusive manner
  • Resell or redistribute the Service without authorization
  • Generate listings for prohibited or restricted items on any marketplace platform

6. AI-Generated Content

  • Listing content is generated by artificial intelligence and is provided as suggestions only.
  • You are solely responsible for reviewing, editing, and approving all generated content before posting it to any marketplace.
  • We do not guarantee the accuracy of pricing suggestions, category recommendations, or market intelligence data.
  • AI-generated descriptions may occasionally contain inaccuracies. Always verify item details before listing.

7. Market Intelligence

Market data is sourced from publicly available eBay listings via the eBay Browse API. Pricing statistics and comparable listings are provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of market data. Actual selling prices may vary.

8. Intellectual Property

You retain ownership of all content you provide to the Service (descriptions, photos). You own the AI-generated listing content created through your use of the Service and may use it freely on any marketplace. The Listing Buddy name, logo, and application code are the property of Fennec Forge LLC.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind, either express or implied. Fennec Forge LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim. We are not responsible for any losses resulting from listing content, pricing decisions, or marketplace transactions.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue the Service at any time with reasonable notice.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the Account page. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to update these Terms of Service at any time. We will notify users of material changes by updating the "Last updated" date on this page. Continued use of the Service after changes constitutes acceptance of the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in the Commonwealth of Pennsylvania.
